IC 35-45-4-1 Version a

Public indecency

(1) engages in sexual intercourse;

(2) engages in deviate sexual conduct;

(3) appears in a state of nudity with the intent to arouse the sexual desires of the person or another person; or

(4) fondles the person's genitals or the genitals of another person;

commits public indecency, a Class A misdemeanor.

Chapter 1. Who May Marry

IC 31-11-1-1

Same sex marriages prohibited

Sec. 1. (a) Only a female may marry a male. Only a male may

marry a female.

(b) A marriage between persons of the same gender is void in

Indiana even if the marriage is lawful in the place where it is

solemnized.

On September 4, 2014 the Seventh Circuit appeals court declared Indiana’s law banning marriage equality as unconstitutional. The state of Indiana will appeal to the US Supreme Court. Stay tuned.

Federal court decision declaring that same-sex couples in IN have the freedom to marry and that marriages legally performed in other states must be respected. Ruling stayed pending appeal, besides one couple that includes a terminally ill woman.
